The key words are, "... title and ownership in the Eligible Used Device transfers to GoPro and you disclaim any further right, title or interest".
In other words, when you sent it to GoPro, it ceased to be your camera.

[ New ]I sent my old HERO to gorpo for the tradeup program in November 2018. Camera was received by gopro via fedex on December 10 2018. I have not received my new camera and it is now January 25, 2019. Gopro states that they will send your new camera in 14 business days. That is a lie. My initial conversation with gopro indicated that I would have my camera in time for an important event. I did not have the camera. This is starting to stink. It feels like theft. Gopro took my old HERO and kept it. They have no information everytime I call. I would live to file a police report but the operators are not in the United States. My camera was sent to California. The shipping is from Kentucky. Nobody at customer service has any phone numbers or addresses for the locations in the United States. You should be happy that the trade up program is over, becasuse it doesn't work. Meanwhile, they still have my camera. I do not.
