What happens if the MAX updates don't work?

For weeks now Gopro has been telling us to be patient, they are working on fixes to the app, and an editor for Windows.

The big question is:

What happens if the updates don't fix the problems?
What happens if the Windows editor is as buggy as the Android app?

If we've done our part and held onto the Max past the 30-day return period, what if the promised software never makes it work?

Can a GoPro camera be returned (past the 30 days) as faulty, on the basis that there's no way to edit the 360 footage?
