Just to update. When I got back from my vacation in Cancun, I responded with all the details and had to send in my package. Im from Canada and apparently due to whatever IRS or CRA reason, Gopro cannot cover shipping(so youll have to pay for it yourself). I sent the package on Jan 13th, and received it on Jan 26th. The package only came with the go pro, as they told us to keep the SD card, battery, and case.
With the new go pro I received....I feel that the partitions for the USB and battery are more flimsy than what I had which scares me about being waterproof. Initially the go pro was overheating and turning on and off by itself, but after the update to v 1.55 I think that fixed it. edit: I forgot to add that the lens cover had a black mark on it which doesnt affect its use so I am not going to complain about it - however some people noted getting a refurbished go pro..
I dont feel comfortable that go pro is marketing the go pro 5 as waterproof...I will be buying a case for it.
Im a little bit disappointed with this, I wish that it was still under warranty as I would have returned this and got something else.

Actually waterproofness is one of the feature that greatly influence on the choice among others action cameras.
Due this i have questions:
1) Where i can read narration about research of defect and declared conclusions?
2) This is the result of error on the technological process?
2.1) The company has eliminated the failure of the technological process?
2.2) Where is official documents | announcements
that proof what company has eliminated the fail of the technological process or at least work on it?
3) What serial number have batch of products with defect?
4) Do company have serial numbers of products with defect?

My partner and I bought a GoPro Hero 5 two months ago because its waterproof body was supposed to allow users to operate it up to 33 feet underwater without the need for a separate housing. Brought it to take photos in very shallow water and after a few minutes the camera just stopped working. It was unfortunate because it's the only camera we brought for our trip. We checked and discovered water leaked inside. We are very careful with our gadgets and made sure the Hero 5 was properly locked before use.
Contacted GoPro and sent the faulty unit in. Just received a replacement; but not sure if this is a new unit or they just fixed the old one. Have yet to try if it works because GoPro did not include a new set of battery and microSD. These items will cost us about PHP 3000 (about USD 60). Also, GoPro Hero 5 batteries are hard to come by here in the Philippines. Checked 5 camera shops in our area and they don't have it in stock. I appreciate the relatively fast response from GoPro but GoPro should have provided these items and perhaps a Super Suit (which we're now planning to purchase since we don't trust Hero 5's waterproof feature anymore) to compensate for the inconvenience and the undocumented memories especially since the Hero 5 was not able to do what it's designed and advertised to do.

@reggiew01 - Where did you see droplets of water? Under the lens cover or inside the LCD to the left of the lens cover?
Droplets under the lens cover is normal. The lens cover is removable. If water is getting in there, you can remove the cover, dry it out, and check on the seal. The camera is waterproof with or without the lens cover on.
If the droplets are inside the LCD on the front of the camera though, that's something our Support team can help you with.

I have a replacement hero 5 from water damage to the first one. My first one worked at least 3-4 separate times under water swimming and snorkeling, but then it leaked and was ruined when I was snorkeling. The whole reason I bought the hero 5 was because it was supposed to be water resistant when swimming/snorkeling. I travel for work every week and sometimes end up in a place where I can snorkel, so the hero 5 seemed great. I am now concerned that the replacement will leak as well. I'm guessing that GoPro will not send me a replacement camera every time it leaks...
