I'm on my third replacement and I stamped my feet and bitched as much as you did and there's no way to tell if they sent a new one unless you compare the serial numbers.  

From what I can surmise from the serial numbers the replacement cams have been a lower number than the one I bought....a wild guess would be refurb.  If it's not arriving in sealed consumer packaging then you can be sure as hell that it's a refurb.

 

The outsourced CS department is really a bummer and you can tell that they don't know the product and are working off of a menu.

True enough that I don't know as it looks like a brand new units and I used a magnifying glass inside and out. All I can say is that I got a replacement unit that looks and works like brand new and they also replaced my battery. Did this to say I won't be using it without the case when submerged in water. Especially saltwater. I don't know how the company stays in business to tell you the truth knowing that there Prime camera that is currently being marketed as an underwater camera is failing on a regular basis.

Are you really sure that it's failing on a "regular basis"? I mean there are some posts about it on this forum but you don't know how many they have sold and how many actually have this problem.

 

I haven't submerged mine yet and am a bit afraid of doing so as the door of the battery compartment isn't as tight as the one for the USB port but still... on a regular basis would mean that ALL cameras have this problem, which I doubt.

Niconj, this is only one place where the customers are speaking out. Many don't post anywhere. Just these few incidents are too many in my opinion. This camera is waterproof up to 10m. If it is failing at surface or 2-3m max then what does that tell you? If a company says there unit is good up to a certain point there is usually a safety Factor built into it over and above. None of the people here even came close to 25 or 50% of the intended use of these GoPros. I am an engineer and can tell you right now the sealing mechanism and latches on the doors leave much to be desired as they set themselves up for failure due to the slide mechanism that locks them. I can also assure you that I had always closed 100% And I'm pretty sure that most people here have done the same. You spend $500 on a camera I am guessing you are going to take care of it.

I had also written reviews on the gopro website and raised a few queries yesterday before writing on this forum;

all of a sudden today I got an email advising that they have re-reviewed my case and will be willing to replace the camera once I return the damaged one;

Based on some of the comments on here, I have advised that unless replacement is new in box and they provide a waterproof case, that I will be wanting a full refund rather than a replacement,  am yet to hear back but am looking forward to hearing the reply

I will also persist that GoPro should provide a SuperSuit case for those of us who have had this issue. Perhaps the replacement one they sent ime s not defective, but I don't want to take that chance and lose half a vacation's worth of memories risking it.

Good luck with those endeavours, I can tell you from my experiences they will be sending you a label to return it and replacing it with a refurb, granted they are "equivalent" to new but not actually new (the serial number will most likely be lower than the one you sent back).  

 

I had also mentioned that I would rather have a refund but they were not going to do that.  The mistake I made was I should have sent it back to the store I bought it from and not the manufacturer; also the different serial number will prevent me from returning it to the store.

If you bought from gopro directly then you should be able to do that through your credit card company.

 

I have not even taken mine in any water yet except to rinse it off in the sink....now I'm worried about potential leaking.

I think it a a sign of a true defect, with all of these leaking problems.  Especially considering the fact that these leaks are all occurring WELL within the recommended use limits of the device.    There is a known problem here, and GoPro is refusing to acknowledge the defect.  Furthermore, they actually seem to be blaming the users of their product.  Bad, bad course of action for a company to take.  

For me, I am on my 4th Hero5 black.  The first one leaked while snorkeling in 8' of water.  The 2nd was a replacement, but was scratched up and refurbished.  The 3rd, while it seemed to be in good condition, got extremely hot when recording and would shut itself down repeatedly.  Also, I could not get more than 45 minutes of video from a single, fully charged, brand new battery.  

The 4th one seems to be OK.  While the customer service rep repeatedly encouraged me to use it in the water as per the GoPro specs, there is no way I will use it without the scuba suit in anything more than a light rain.  I been without the camera way more than I've been with it, and am frankly just sick of dealing with it.  

As for the replacements, they flat out refused to send me a new one.  I was told they were new, but they came in a brown cardboard box, totally without the new packaging and accessories which come with a new one.  So good luck getting a "new" camera.  

For me, I bought this camera because me and my kids play a lot in 10' of water, and this camera seems perfect for that.   However, I cannot use it for that.  If I would have know this was going to happen I would have bought a different camera.
